1. About Mayfair Motors and our marketplace role
Mayfair Motors is a United Kingdom company operating an online marketplace that facilitates introductions and bookings between independent Hosts and Guests.
We are a technology platform provider. We are not a vehicle rental company, motor trader, insurer, transport operator or agent for any Host or Guest in respect of vehicles listed on the platform.
Our role is limited to providing marketplace tools - including account registration, listing publication, search and discovery, booking requests and confirmations, payment facilitation, identity and licence verification, communications between users, and administrative support for trust and safety.
Nothing in these Terms creates a partnership, joint venture, agency, employment or franchise relationship between Mayfair Motors and any Host or Guest. Hosts and Guests act on their own behalf and at their own risk in respect of vehicle hire.
2. Acceptance of these Terms
These Terms form a binding agreement between you and Mayfair Motors when you access or use the platform.
You may also be asked to accept additional terms during onboarding, at checkout, when listing a vehicle, or in connection with specific features (for example, host onboarding declarations, insurance options or promotional programmes). Those additional terms apply alongside these Terms. If there is a conflict, the additional terms prevail for the relevant feature to the extent of the conflict.
You must read these Terms and our Privacy Policy before using the platform. Continued use after we publish changes constitutes acceptance of the updated Terms, except where the law requires additional consent.
3. Eligibility
To use the platform, you must:
- Be at least 18 years old and legally capable of entering into binding contracts.
- Be resident in the United Kingdom or otherwise eligible to use our services as we permit from time to time.
- Provide accurate, complete and current information about yourself.
- As a Guest, hold a valid driving licence that is legally recognised in the United Kingdom for the class of vehicle you wish to hire, and meet any additional licence age or experience requirements shown on the listing or during booking.
- As a Host, have the legal right to make the vehicle available for hire and to receive payment for that hire.
- Not be suspended, removed or banned from the platform.
- Comply with all applicable laws, including road traffic, insurance, tax and consumer protection laws.
Business users
If you use the platform on behalf of a company, partnership or other organisation, you confirm that you have authority to bind that entity and that “you” includes that entity.
4. Account registration and verification
You must create an account to list vehicles, make bookings or use most platform features. You agree to provide accurate information and keep your account details up to date.
We may require identity verification, driving licence verification, proof of address, payment method verification, vehicle documentation or other checks before you can list, book or receive payouts. We may use third-party verification providers for this purpose.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorised access.
We may refuse registration, request further information, limit functionality or decline a booking where verification is incomplete, unsuccessful or where we reasonably believe there is a risk to users, the platform or compliance with law.
One person must not maintain multiple accounts to evade restrictions, misrepresent identity or circumvent platform rules.
5. Host obligations
If you list a vehicle as a Host, you agree that:
- You are the owner of the vehicle, or otherwise have lawful authority to make it available for hire and to enter into rental agreements with Guests.
- All listing information - including make, model, registration, location, availability, pricing, photographs, mileage limits, fuel policy, delivery options and vehicle features - is accurate, complete and not misleading.
- The vehicle is roadworthy, has a valid MOT where required by law, is taxed as applicable, and is maintained in a safe and clean condition suitable for hire.
- You will comply with all laws applicable to hiring out your vehicle, including insurance, licensing, tax and vehicle safety requirements.
- You hold appropriate insurance for peer-to-peer vehicle hire, or you will use insurance arranged through or approved by Mayfair Motors where that option is offered for a particular listing or booking. You must inform us and Guests of any material insurance restrictions, exclusions or excess requirements.
- You will honour confirmed bookings except where cancellation is permitted under these Terms, the booking terms shown at checkout, or applicable law.
- You will make the vehicle available at the agreed time and location, provide reasonable handover instructions, and respond promptly to Guest messages relating to an active or upcoming booking.
- You will not cancel bookings to re-list the same dates at a higher price, discriminate unlawfully against Guests, or substitute a different vehicle without the Guest’s informed consent.
- You will report accidents, theft, damage, safety defects or insurance incidents promptly and cooperate with Mayfair Motors, Guests and insurers in resolving them.
Pricing and availability
You are responsible for setting or accepting the hire price, mileage allowances, delivery fees, cleaning fees, fuel charges and other amounts applicable to your listing, subject to any platform pricing rules described in section 12.
You must keep your calendar and availability accurate. Repeated unavailability after confirmed bookings may result in account restrictions.
6. Guest obligations
If you book a vehicle as a Guest, you agree that:
- You hold a valid driving licence recognised in the United Kingdom for the vehicle class and meet any age, experience or additional driver requirements stated on the listing or at booking.
- You will use the vehicle only for lawful personal or business purposes permitted by the Host, these Terms and applicable law.
- You will treat the vehicle with reasonable care, drive safely and in accordance with road traffic laws, and return it on time, in substantially the same condition as at handover (fair wear and tear excepted), with the agreed fuel level and mileage.
- Only drivers approved for the booking may drive the vehicle, unless the Host and booking terms expressly permit otherwise.
- You will not use the vehicle for racing, track days, off-road driving where prohibited, carrying hazardous materials, sub-hiring, commercial carriage of passengers for reward, or any other prohibited use described in section 11.
- You will pay all hire charges, platform fees, insurance charges, delivery fees, tolls, fines, penalties, congestion charges, fuel shortfalls, excess mileage, cleaning fees, damage charges and other amounts you owe in connection with the booking.
- You will report accidents, theft, breakdowns, defects or damage to the Host and Mayfair Motors promptly and cooperate with insurance and claims processes.
- You will not tamper with the vehicle, its tracking or telematics equipment, registration documents or insurance records.
Additional drivers
Where additional drivers are permitted, they must meet the same eligibility and verification requirements and be added to the booking before they drive. You remain responsible for the conduct of anyone you allow to use the vehicle under your booking.
7. Bookings and rental agreements
The platform allows Guests to request or confirm bookings and allows Hosts to accept or decline requests according to the booking flow shown at the time.
A rental agreement for a specific hire is formed directly between the Host and the Guest when a booking is confirmed, on the terms shown during the booking process (including dates, location, price, mileage, insurance option, cancellation rules and any listing-specific conditions). Mayfair Motors facilitates that agreement but is not a party to it unless we expressly say otherwise in writing.
You must review all booking details carefully before confirming. Hosts and Guests are responsible for ensuring the booking terms meet their needs and legal obligations.
Mayfair Motors does not guarantee that any listing will be available, that a Host will accept a request, or that a Guest will complete a hire. We may cancel or modify a booking where required by law, for fraud prevention, for safety reasons, due to technical error, or where these Terms permit.
Handover and return arrangements are primarily between Host and Guest. Both parties should inspect the vehicle together at handover and return, record mileage and fuel level, and note existing or new damage. We may provide tools or templates to assist, but the primary responsibility for condition documentation rests with Host and Guest.
8. Payments, fees, refunds and cancellations
Payments on the platform are processed through third-party payment providers. By making or receiving payments through the platform, you agree to the payment provider’s terms as applicable.
Guests authorise Mayfair Motors and our payment partners to charge the payment method provided for the total booking amount shown at checkout, including hire charges, insurance charges where selected, delivery or add-on fees, security deposits or pre-authorisations, and applicable platform or service fees.
Hosts authorise Mayfair Motors to deduct applicable platform fees, commissions, chargebacks, refunds and adjustments from payouts before remitting the balance in accordance with our payout schedule.
Specific fees, commissions and payout timings are shown during onboarding, in the Host dashboard, at checkout or in separate fee schedules we publish from time to time. We may update fees on reasonable notice, but confirmed bookings will generally be processed under the fees shown at the time of booking unless otherwise required by law.
- platform service fees: Mayfair Motors may charge Guests and/or Hosts service fees for use of the marketplace, payment processing and related services.
- Host commission: Mayfair Motors may retain a commission on hire revenue as disclosed to Hosts.
- Taxes: Hosts are responsible for any tax obligations arising from hire income. Guests are responsible for any applicable taxes on fees we charge them, except where we are required by law to collect and remit tax.
Deposits
Mayfair Motors holds security deposits on the platform. Where a booking requires a refundable deposit or card pre-authorisation, we (or our payment partners) take and hold that deposit through the platform.
If there are damages, excess mileage, cleaning fees, fuel shortfalls, fines, congestion charges or other extra charges connected to a hire, Mayfair Motors Claims will handle the process. That includes gathering evidence from Hosts and Guests, reviewing before and after hire media where provided, liaising with insurers where appropriate, and applying amounts against the held deposit where permitted by the booking terms and applicable law.
Subject to any deductions permitted under these Terms and applicable law, deposits will be returned within 14 working days of completion of the hire and resolution of any claim. Return may take longer where parking or penalty notices take time to arrive, or where a claim remains unresolved.
Refunds and cancellations
Cancellation rights depend on the cancellation policy shown for the booking, these Terms and applicable consumer law. Where a Guest cancels within any free-cancellation window shown at checkout, eligible refunds will be processed to the original payment method, minus any non-refundable fees clearly disclosed at booking.
If a Host cancels a confirmed booking, the Guest will receive a full refund of amounts paid through the platform for that booking, and the Host may be subject to penalties or account restrictions.
Mayfair Motors may issue refunds where required by law, where a booking cannot be fulfilled due to platform error, or where we reasonably determine a refund is appropriate following investigation. Issuing a refund does not limit our right to recover amounts from the responsible party.
Chargebacks made without first contacting us or the other party may result in account suspension. We may share booking records with payment providers to respond to disputes.
Late return and additional charges
Guests who return a vehicle late may be charged for additional hire time, inconvenience and any costs incurred by the Host or next Guest, as permitted by the booking terms and applicable law. Hosts must not impose unreasonable penalties.
9. Insurance
Insurance is a critical part of peer-to-peer vehicle hire. Responsibility for adequate insurance rests primarily with the Host and Guest, according to the insurance option selected for the booking.
- Host own policy: Where a Host relies on their own motor insurance or a commercial hire policy, the Host confirms that the policy permits peer-to-peer hire for paying Guests and covers the intended use. Hosts must provide accurate policy information and notify us of material changes or cancellations.
- platform-arranged insurance: Where Mayfair Motors or a partner offers insurance for a booking, coverage terms, exclusions, excess amounts and claims procedures will be shown during booking or in separate insurance documentation. That insurance is between the insured party and the insurer; Mayfair Motors is not the insurer unless expressly stated.
- Guests must review coverage limits, exclusions and excess before driving. Driving without valid insurance is prohibited.
- Mayfair Motors does not guarantee that any insurance product will cover a particular incident, driver, location or use. Coverage decisions are made by the relevant insurer according to policy terms.
Important insurance disclaimer
Mayfair Motors is not an insurance intermediary, insurer or broker except where we expressly state otherwise for a specific product. We may facilitate access to insurance partners, but we do not provide insurance advice. Hosts and Guests should obtain independent advice if they are unsure whether cover is adequate.
Failure to maintain valid insurance, failure to report incidents promptly, or use outside permitted terms may void coverage and create personal liability for the responsible party.
10. Vehicle condition, inspections, damage and disputes
Hosts are responsible for supplying a roadworthy vehicle. Guests are responsible for returning it in accordance with the booking terms and reporting any issues promptly.
We strongly recommend that Hosts and Guests conduct a joint inspection at handover and return, with dated photographs of the vehicle exterior, interior, mileage, fuel level and any existing damage.
If damage, loss, theft, mechanical failure, cleaning issues or missing items arise during or after a hire, the Host and Guest should attempt to resolve the matter promptly and in good faith. Either party may notify Mayfair Motors through the platform.
Mayfair Motors may, at our discretion, assist with communication, evidence collection, deposit handling or information sharing with insurers. We are not obliged to adjudicate disputes between Hosts and Guests and we do not guarantee an outcome.
Where damage or other charges are disputed, we may temporarily hold deposits or delay payouts pending review. Our decision regarding platform-facilitated payments is without prejudice to either party’s legal rights against the other.
Nothing in these Terms prevents a Host or Guest from pursuing a claim under insurance, against the other party directly, or through courts or other lawful dispute processes.
11. Prohibited uses and conduct
You must not use the platform, or any vehicle booked through it, in any way that is unlawful, unsafe, fraudulent or harmful. Prohibited conduct includes, without limitation:
- Providing false, misleading or incomplete identity, licence, vehicle or insurance information.
- Using the platform to arrange hires off-platform to avoid fees, verification or insurance requirements.
- Discriminating against users on unlawful grounds.
- Harassing, threatening, abusing or endangering other users.
- Using a vehicle for illegal activity, uninsured driving, racing, speed contests, teaching unauthorised driving lessons for reward, or carrying goods or passengers in breach of law or booking terms.
- Tampering with odometers, VIN plates, safety equipment or emissions controls.
- Smoking in vehicles where prohibited, carrying pets where prohibited, or returning a vehicle in an unreasonably dirty or biohazard condition.
- Attempting to bypass platform security, scrape data, reverse engineer systems or interfere with service operation.
- Using bots or automated tools to create accounts, listings or bookings without our permission.
- Infringing intellectual property or privacy rights of Mayfair Motors or other users.
- Money laundering, sanctions evasion or other financial crime.
Consequences
We may investigate suspected violations, suspend or terminate accounts, remove listings, cancel bookings, withhold payouts, report conduct to insurers or law enforcement, and take other action we reasonably consider necessary to protect users and the platform.
12. platform rules, listings approval and pricing
We may publish community standards, host guidelines, guest guidelines, pricing guides and other platform policies from time to time. Those policies form part of how the platform operates and must be followed unless they conflict with these Terms or applicable law.
All listings are subject to review and approval before publication. We may approve, reject, suspend or remove listings that do not meet our quality, safety, insurance, photographic, pricing or legal standards.
For certain Host applications and fleet onboarding, Mayfair Motors administrators may set or approve the platform list price at which a vehicle is published to browse. The published list price may differ from a Host’s suggested price where we apply marketplace pricing standards. By proceeding with onboarding or approval, the Host authorises publication at the approved list price unless otherwise agreed in writing.
We may feature, rank, promote or limit visibility of listings based on quality, availability, performance, subscription tier or other reasonable business criteria.
We do not guarantee any minimum number of bookings, earnings or listing placement.
13. Intellectual property
The platform, including its software, design, branding, logos, text, graphics and underlying technology, is owned by or licensed to Mayfair Motors and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell or create derivative works from any part of the platform.
You retain ownership of content you submit, such as listing photographs and descriptions. You grant Mayfair Motors a non-exclusive, worldwide, royalty-free licence to use, host, reproduce, display and distribute that content for the purpose of operating, marketing and improving the platform.
You confirm that your content does not infringe third-party rights and that you have permission to use any photographs, trade marks or other materials you upload.
If you believe content on the platform infringes your rights, contact info@mayfairmotors.co.uk with sufficient detail for us to review the complaint.
14. Limitation of liability
To the fullest extent permitted by law, Mayfair Motors shall have no liability to you for any loss, damage, cost, claim or expense arising from or related to your use of the platform, any rental, or any interaction between Hosts and Guests. Nothing in these Terms excludes or limits liability where it cannot legally be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
We do not warrant that the platform will be uninterrupted, error-free or free from harmful components. We provide the platform on an “as is” and “as available” basis.
If you are a consumer, you have legal rights in relation to services that are not performed with reasonable care and skill. Nothing in these Terms affects those statutory rights.
15. Indemnity
You agree to indemnify and hold harmless Mayfair Motors, its directors, officers, employees and contractors from and against claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms or any additional terms applicable to you.
- Your use of the platform, a listed vehicle or a booked vehicle.
- Your violation of law or the rights of a third party.
- Any rental agreement you enter into as a Host or Guest.
- Inaccurate information you provide, including identity, licence, vehicle or insurance information.
- Any claim by another user, insurer, payment provider or authority connected to your conduct.
Consumers
This indemnity applies only to the extent permitted by applicable law. If you are a consumer, it applies solely in respect of losses caused by your breach of these Terms or your unlawful conduct.
16. Suspension and termination
You may close your account at any time by contacting us, subject to completion of outstanding bookings, payments, disputes and legal retention requirements.
We may suspend or terminate your account, remove content, cancel bookings or restrict access immediately where we reasonably believe you have breached these Terms, created risk to users or the platform, failed verification, engaged in fraud or abuse, or where required by law or a payment partner.
On termination, provisions that by their nature should survive - including payment obligations, indemnity, limitation of liability, dispute resolution and intellectual property - will continue to apply.
Termination of your platform account does not automatically cancel rental agreements already formed between Host and Guest, although we may take steps available to us on the platform to notify the parties and manage payments.
17. Dispute resolution and governing law
We encourage Hosts and Guests to resolve booking disputes directly and in good faith. If you need platform assistance, contact info@mayfairmotors.co.uk with your booking reference and a clear description of the issue.
If you have a dispute with Mayfair Motors, please contact us first so we can try to resolve it informally.
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
If you are a consumer, you may also be entitled to use alternative dispute resolution schemes or online dispute resolution services available in your jurisdiction. We are not obliged to participate in such schemes unless required by law.
18. Changes to these Terms
We may update these Terms from time to time to reflect changes in law, platform features, business practices or market conditions. The “Last updated” date at the top of this page shows when they were last revised.
Material changes will be communicated through the platform or by email where appropriate before they take effect. Your continued use of the platform after the effective date constitutes acceptance of the updated Terms, except where the law requires your explicit consent.
If you do not agree to updated Terms, you must stop using the platform and close your account, subject to completion of existing bookings and obligations.
